Terms and Conditions of Agreement
These Terms and Conditions form part of the agreement between TURNER ROOFING SPECIALISTS LIMITED ("the Contractor") and you ("the Client"). The agreement covers all works, repairs, and installations as specified in the quotation provided. In these terms, "we," "us," and "our" refer to TURNER ROOFING SPECIALISTS LIMITED, and "you" and "your" refer to the Client, whose details are outlined in the quotation.
1. Quotations and Estimates
Quotations: TURNER ROOFING SPECIALISTS LIMITED provides written quotations free of charge, unless otherwise specified.
Surveys: Surveys are charged out at a predetermined fee, varying on the scale of the property and the level of detail requested by the client, certain conditions apply. For example, if a property is listed for sale or is in the process of being sold, a charge of £200 + VAT may apply.
Quotation: A quotation represents the agreed cost for the works outlined, unless additional works are requested by you.
Estimate: An estimate is a provisional cost for works or services, subject to change based on unforeseen circumstances.
2. Acceptance of Quotation
Written Confirmation: To proceed with the works, you must provide written confirmation of your acceptance of the quotation via email, SMS, or letter. This must be received at least 7 days before the scheduled start date.
Right to Cancel or Postpone: You may cancel or postpone the work within this 7-day period.
3. Validity of Quotation
The quotation provided by TURNER ROOFING SPECIALISTS LIMITED is valid for 21 days from the date of issue. After this period, we reserve the right to revise the quotation due to changes in material or labour costs.
Once the quotation is accepted in writing, any increases in material or labour costs during the 21 day period will not be passed on to the Client.
4. Commencement and Completion of Works
We will aim to commence the work on the agreed date and complete it within a reasonable timeframe, subject to unforeseen circumstances or adverse weather conditions.
TURNER ROOFING SPECIALISTS LIMITED is not responsible for delays caused by:
- Additional works requested by the Client
- Third-party involvement
- Material shortages
- Adverse weather
- Any other circumstances outside our control (*Force Majeure*).
5. Ownership of Materials
- Any materials supplied and stored on site in relation to the contract remain the property of TURNER ROOFING SPECIALISTS LIMITED until full payment is received.
6. Defects and Liability
If any issues arise with the work carried out by TURNER ROOFING SPECIALISTS LIMITED, you must notify us in writing within 21 days of completion. TURNER ROOFING SPECIALISTS LIMITED will not be liable for any defects or issues reported after this period.
Client Responsibility: Any damage to materials or works caused by third parties during the course of the works is your responsibility. You will be liable for the cost of repair or replacement unless negligence on the part of TURNER ROOFING SPECIALISTS LIMITED can be demonstrated.
7. Access to Property
You agree to provide us with necessary access to your property to carry out the agreed works. If access to neighbouring or adjacent properties is required, it is your responsibility to obtain written permission from the relevant parties and provide us with a copy before work begins.
You also agree to grant us access to mains services (such as electricity and water) to complete the works.
8. Invoicing and Payments
All invoices are subject to VAT at the prevailing rate unless otherwise specified (e.g., for listed buildings or new builds).
Payment must be made in full within 7 days from the invoice date. Any unpaid invoices after 21 days will incur an interest charge of 2% per month above the base rate for each month the invoice remains overdue.
No retentions will apply unless specifically agreed in writing before work begins.
Payments should be made via BACS or cheque, payable to TURNER ROOFING SPECIALISTS LIMITED, and you must reference the invoice number when making payment.
9. Insurance
- TURNER ROOFING SPECIALISTS LIMITED holds full Public Liability Insurance (£5,000,000) and Employers Liability Insurance (£10,000,000). We also adhere to a Health & Safety Policy and provide Risk Assessments where required.
10. Photographic Documentation
- We take pride in the quality of our work and may wish to document it with photographs. If you do not wish for photographs of your roof or property to be used for promotional purposes, please inform us in writing. We will not disclose any details that could reveal the location or identity of the property.
11. Force Majeure
Force Majeure refers to unforeseen events beyond the control of either party that prevent or delay the performance of the contract. These events may include, but are not limited to:
- Natural disasters (e.g., storms, floods)
- Severe weather conditions
- Labour strikes or shortages
- Changes in government laws or regulations
- Other events beyond our control.
